The importance of writing a Will and understanding intestacy – 4th March 2025

Making a Will is one of the most important steps you can take to ensure your loved ones are cared for after your passing. A Will allows you to specify how your assets should be distributed, appoint guardians for your children, and express your final wishes clearly. Without a valid Will, your estate will be distributed according to intestacy laws.

What is intestacy?

Intestacy occurs when a person dies without a valid Will. In such cases, their assets are distributed according to the laws of intestacy. These laws determine who inherits the estate, usually prioritising close family members such as spouses, children, and parents. However, intestacy can create complications, delays, and unintended outcomes when assets exceed £322,000 and particularly in blended families, or for unmarried partners who may not be legally entitled to inherit.
